Nope, see just plain wrong there. In most states you can be charged with assualt with a deadly weapon or aggravated assault just for brandishing a gun in a situation where your life isn't at risk. Its not a morality question in any way, its simply the way our laws are structured. If you don't intend to shoot immediately, you don't pull it out. Now I am specifically talking about being outside of your home. The assault charges would never be filed against you for pulling out the weapon inside of your house. But outside of your home, I've seen the exact scenario of a guy with a concealed carry permit walks out into the mall parking lot to find some punks breaking into his car and stealing his stereo. He tells them to get away from his car, and one starts walking towards him. He pulls his concealed carry gun and said something like "you don't want to start anything here, i'm armed" and later got charged with assault.
