Can my gym get sued?

Few of us have been complaining the past few weeks that it's to hot when this one PT is working and he always says ah I love the heat well the temp in here today is 82 degrees and this middle aged guy passed out from what seems to be heat stroke even after this trainer was told by ppl it's to damn hot and he always says good you will burn more cals well all it does is make me sick and dizzy so the paramedics were called and they even said omg it's hot in here so what do you guys think?
 
lawsuit waiting to happen. PT should be let go before they get sued, this way they can say that they have taken precautionary measures. there comes a point when the risk outweighs the benefits. if that PT isnt the owner of the gym, then someone should tell the owner of the gym cause he's setting them up for a court date. waiver or no waiver, the gym wouldnt stand a chance in court for that type of issue.
 
It's a YMCA ill go talk to the CEO guy I always see him in his office I almost threw up doing squats today man it's just not fun to lift when it's that hot

imagine squating 315lbs then fainting due to heat exhaustion, then getting injured due to that issue... your talking about hospital bills, pain and suffering, physical therapy, list just goes on. i would probably feel bad for the CEO of my gym if his family got sued and lost everything because of an immature PT.

i mean, thats all you can really do is talk to the guy and let him know this way he's aware of the situation.
 
Anyone can sue anyone for anything. It's being able to win the lawsuit that counts.
 
One day I hope to be so important that I have control of a thermostat to torture people with.

Seriously - that PT needs to get a ****in' life. Maybe he's never been laid and just upset about it - so he's torturing people to get even.

OP - What temperature is it supposed to be when you are working out?
 
Comfortable temperature is relative. Here in Arizona on a 115° day an 80° room temperature is quite cool. The inverse would apply in a climate of 45°.
 
Most gyms have you sign a waiver relieving them of any fault do to any injury's.
 
When I lived in Glendale Arizona my gym would be as David said about 80 but walking in on a 110+ degree day it feels comfortable but your also adapted to a different climate and your body reacts different. The other day it was 70 outside and the gym was 80+ inside here in Michigan and it felt nasty hot and funky, it's 24 hour an unattended much of the time so I took it upon myself and propped the back doors open and aired the place out since the AC was def not on. To intentionally put gym members in an uncomfortable environment is highly unprofessional and selfish. That personal trainer would most likely see a side of me I hate to let out but Id see that as immediate disrespect when I'm spending my money on something and get a **** you response from an employee of the establishment when a valid complaint is made. Have a talk with the manager/ owner and have his ass!
 
Switch damn gyms.

My old 24 gym I could feel the a/c blowing sometimes.

This new one is kept very comfortable.
 
80 isn't anywhere life-threatening. It's probably not comfortable for everyone, but heat exhaustion is highly unlikely.
 
I hate it when the gym is cold,when im done with a workout being covered in sweat then freezing cold is never the way I like it,then walking out into 95 with 100% humidity.Id rather them just keep it at 80 here then you wouldnt walk out the gym feeling microwaved.
 
80's warm, but its not that bad. Ive worked out in worse.
 
I think it makes it worse when the air is stagnant and dank. There has to be constant ventilation and airflow throughout the gym or it becomes suffocating even though the heat may not be that intense.
 
Interesting thread here. Health concerns with the heat that high. Why risk it?
 
If it is that much of a problem why not just change gyms?
 
i dont mind heat. but when a senior citizen passes out and multiple members are complaining to the staff that it's too hot, then something needs to be changed. you can sue for anything now days and it doesnt mean your going to win. but when people are already complaining then a senior citizen passes out, i have a gut feeling they would lose in court.

80 degress isnt hot... but 80 degrees with no ventilation or air flow will most definetly feel like 95 degrees.

Well, I live in Southern Louisiana and I've worked out in 80 degree heat in the gym when the A/C was busted. It wasn't fun at all.

Then again, I don't wear a shirt at home with the AC dialed to 70F, because it's still not cool enough for me.

This might be a good time to mention that I spend about 2 months out of every year in the Artic Circle on the Ice. Soooo ... yeah maybe you're right and I'm not the best one to judge workout temps! LOL
 
I was born and raised in florida,my body thrives on heat,its the opposite of the cold though,I hate it so much,cant get motivated,my muscles dont seem to wanna warm up.I dont know,may all just be in my head,but it may not.
 
I keep my gym at 62-65. My clients love it. Breathing becomes easier.
 
I personally hate a gym with the air conditioning that's blasting... my gym has these giant fans on the celing and there is always a big breeze i hate that makes me cold i don't like to get cold easy... 80 though seems a little hot!
 
There is a gym by me that does not have heat in the winter and no air con in the summer, i honestly don't know how people work out there! Its like A Gigantic garage you literally have to wear "gloves" to work out in the winter... crazy sh*t

I would love that gym In the winter. I like lifting out in the garage in 20-30 degree weather. I feel i breath easier in the cold and always feel short winded in heat

same here man. when it's hot and humid, i sweat more but i get exhausted faster then feel like i didnt get a good workout in. when it's cool in my gym, i can sit there for 2 hours easily and go harder, breathing is so much easier and im not as irritable.

My gym used to have a waiver that you would sign every time you sign in. It removes the own of the gym from any liability. I think it had more to do with if the person uses the equipment incorrectly or something of that nature. Now we just have this card we scan. The gym I go to doesn't put the AC on till late June so it gets hot in there also. A lot of people disappear in the summer months and then they are back in the fall/winter. Yes its hot but you just have to make sure to drink extra water and take more time between sets....

Yeah I've seen some gyms that just have fans lol... My 24hour fitness has a/c and all. They got rid of the scan card and I just use my finger; Free towels when I come in, steam room & a pool, basketball court, only thing they are missing is a smoothie bar. I pay around $28 a month too.
 
That's why I keep it cool.
 
This thread makes me glad that the last gym I went to (work out at home now) had the thermostat for the weights area right by the benches. If the AC wasn't on, I put that **** on as soon as I got to the gym, no one complained that i know of :D

Keeping the heat up is ridiculous, especially in the summer, it should not feel hotter in the gym than it did walking through the parking lot.
 
I have never had a problem with a place being too warm. Then again I live in Georgia so I am used to 100 degrees in the summer. Personally I would rather be hot than cold. Used to lift on an Air Force base and it would feel like a freezer in there with way too much air flow. Would get head aches way too often and I am not prone to head aches.
