I just got a email from corporate and they and they may fire me because I repoarted the 80 year old guy in sandals for not wearing propeer shoes. Apparently he knows the owner and told on me to the regional manager. I can't find the city ordinance on it but the city ordinance says you need to wear proper shoes? What do I do. It's unsanitary and dangerous any way.
Suggestions.

find the paperwork, bring it to corporate, show them where it says you need proper shoes...... if they fire you anyway, speak to a lawyer

You were doing the job they hired you to do. If you didn't report that guy then they could say you weren't doing your job and you could get fired..I would definately Lawyer up if they try to fire you. I would do it for principle alone.

Wow, that sucks. Definitely get all the paperwork you can on your side, if you can find something which outlines his violation, send it to corporate, and if it comes down to it, go see a lawyer prior to your firing for a consultation.(even if it costs you a couple of bucks)

I'm trying to find the codes right now. This old guys a ass whole. I'm looking at speaking to my uncle whos a lawyer.

What ordinance and codes are you talking about, you cant wear sandals in the exercise area of a gym, thats just common sense, but it should be written somewhere in the membership agreement or rules of conduct, or handbook, and if you cant find it, call the friggin health department, they have to have a rule against it. You find that, you will be golden.

What was said in the Email? How do you get the feeling that you're going to be fired??

Never to speak of Richard and what he does in the gym again or else they will take disciplinary action. What ever that means.

The city has a ordinance about proper gym attire. I am googling it right now. See it's a apartment complex so we never signed s a what you would call a member ship.

Sounds like your boss is saying the old guy can wear his shower shoes in the gym.

Doesn't sound like you're being fired unless you don't comply with the email directions.

I would just chill ... let the old guy drop a weight on his toes ... the boss says he's clear and the boss is always right.

Pick your battles - I don't think this one should be one.

Sometimes in life you just have to suck it up and eat a sh*t sandwich. I would let the issue die and hopefully the old geyser doesn't give you an attitude now that he knows he calls the shots.

I would tell all my friends to come in wearing sandals when the old guy is there and if anyone says anything, instruct them to say why can he wear them.. (without dropping your name of course)

Personally - I'd save that email. Respond with a very nice email that says you were just trying to do the right thing, but you'll comply with the directions given.

I would also look up that city statute that defines proper foot attire. Make sure YOU aren't liable for the penalty as a worker in the gym. As long as the penalties are paid for by the corporation - you've got no dog in the hunt.

If the penalty IS on you for not enforcing proper foot attire - then point this out to corporate and ask for further direction. If they respond with anything that doesn't sound like they have your back on the penalty - then you take the emails to a lawyer.

I would also say that would be a **** place to work and quit.

EDIT: But seriously ... in this economy what city has the resources to "police" foot attire?

Brilliant idea. I actually will do that. Now for sure they can't say crap to me.

For this to really progress you would first need to figure out how much of your own money you want to spend on a lawyer. You would have to put a retainer down, which is usually 2500$.

The bottom line is that you don't know who this guy is. Now I know he broke the rule, but he may own the joint. If this is just some apartment gym, that is paying you pennies I wouldn't even push the issue.

My uncle is a lawyer. I will ask him how to go about kicking him out.

Well, now, that doesnt say your being fired, its clearly says to me that you need to leave the old guy alone, dont bust his chops, let him be, or if you dont, then you might get fired. Thats how I read it. I could be wrong. Like HondaV65 said, "Pick your battles - I don't think this one should be one." If you want to keep your job, just let this whole thing go.

It's age dissemination. So young people like me can't go bare foot but if your 80 it's okay? I mean rules are there so there is order no kaos.

Trust me I get that, but your boss told you what he wanted you to do, clear as a bell in my eyes, and with the unemployment rate where it is today, unless you have something else lined up, it would be stupid to loose a job over this small of an issue.

Maybe he has some feet issues that make him have to wear that. Like Pedal Edema?

Also I have seen people at my gym sporting those "shoes" that look like you painted your feet and toes. They are the gayest thing ever. The yuppies are all about them now for some reason. How would you feel about those in your gym?

I really don't see what the big deal is... I work out at a huge state of the art fitness center and i see tons of guys training with out shoes, barefoot and in socks. I'm one of those guys. What's the big freaking deal it's not gross dude.. MMA guys and boxers train bare foot. How's it more gross if someone is walking around barefoot then a sweaty ass old hairy guy doing preacher curls in a tank top? Are you eating off the floor in the gym or sleeping on it? Really get over it... Oh yea and when im eating my chicken and brown rice in the locker room i see every asshol* take a pis* or shi t then they walk out with out washing there hands... I'd fire your ass too

Find out now while you can who insures the facility. Then, if you get fired, explain to whomever fires you that's fine, you'll be suing them, and you'll also be reporting them to the insurance company for breach of contract. They pay a rate with their insurer that assumes proper operation of the facility and observance of agreed upon safety measures, of which shoes must be worn. You'll F them far harder than they can F you.

Boxers train with boxing shoes. At least any boxer that I know. MMA is different. I don't know much about MMA. As far as the sanitary fact goes I agree with you. Personally I would just feel wierd if they guy next to me was lifting in socks or bare feet. It's just one of those societal norms.

I was involved in martial arts for years, grew up doing it and we ALWAYS trained bare foot. Just sayin'! Big whooping deal

And when I squat in my socks I make sure I do NOT go walking around the gym. I stay by the squat rack and when I'm done I put my shoes on... ;)

Ths is the email I sent to my boss.

Adam,

I have no problem turning the music down when any one politely asks, however it's very inconsiderate when Richard is not working out and turns off the music completely just to watch tv. I was previously informed by Justin to have the music off prior to 11 to accommodate Richard, however he has now decided to watch tv after 11. Furthermore, concerning his sandals, it is against city ordinance to wear them in the gym. *As far as I am concerned he is an adult and can make an educated decision on proper foot attire; but all us being residents of Garden Communities, we should have equal access and privileges concerning the gym. I have been expelled from the gym for showing up with open-toed shoes. There seems to be confusion about the footwear policy, which should be clarified equally for all residents. On a personal note, I hope this issue can be resolved to suit everybody's mutual interest with out further harassment from Richard. I know that I speak for everybody at the gym in wanting a reasonable (and legal) standard of sanitation, and some form of music during workout hours. Please feel free to send this to all parties involved, so that a we can begin to formulate a resolution.

Regards,
James

So you live in this apartment community and work at it's in house gym? And this guy lives there too?

Doesn't your gym have a policy on wearing "covered" footwear in the workout area? Most, if not all the gyms I've been in have it clearly posted for all to see?!

We both live in the same community. There is a writen statement from the fitness director on the white board and the company has on the wall to wear proper shoe attire. I just got a email back saying he is aloud to break the code and for me to drop it. I am just going to bring my own speakers and just tell him when he comes near the weights to go back to the bike and watch his tv and not to walk around my side for safety.

DJ you seemed a little OCDed out from this and I know you mentioned this before, just alittle advice sometimes when you right your still wrong. its just the way the world works. Now I get the whole deal, but if you end up getting this resolved the way you want and you plan to keep working there then you better expect to work the rest of your time as a perfect employee, because if you make 1 mistake you gonna hear about it, and eventually you will probably be fired.

I would just drop it. It really isn't that big of a deal. More importantly why does this guy have so much pull? That is the question that you need to figure out.

LOL Nice. I workout at a 24 most of the time and they're pretty strict about covered footwear but I use deadlift slippers all the time =P I'm sure if I wasn't pulling weight, they'd say something :fingersx:

Haha!!! Thats awesome rep coming your way
