Hi-Tech to Sue Muscle Pharm's Arnold Series

Hi-Tech to Sue Muscle Pharm's Arnold Series

The bad news for MusclePharm just seems to continue today, as word has got out that fellow supplement company Hi-Tech Pharmaceuticals is now suing the Athlete’s Company. A press release was posted this morning that the guys over at Supplement Reviews have broken down and gone into detail on. The lawsuit has come just a few days after Arnold Schwarzenegger ended his relationship with MusclePharm and the Arnold Series was confirmed as discontinued.

Hi-Tech’s lawsuit appears to be based on MusclePharm allegedly amino spiking its Arnold Schwarzenegger Series mass protein Iron Mass. The press release says that testing revealed a total protein count of 19.53g per serving for Iron Mass instead of the 40g the supplement promises on its label.

For those of you that for whatever reason haven’t heard of amino spiking before, to put it simply it’s when brands throw aminos in their protein powders instead of actual protein. Despite not being the real deal the cheaper aminos are still counted towards a product’s protein total. By doing this a product that may only have 10g of actual protein could say 25g per serving on its label with the help of added aminos like glycine and taurine.

So why is Hi-Tech suing? What does muscle pharms spiking have to do with them?

If they were spiking protein that bad who knows what they were doing with their other products. Shady.

well at the very least it should scare other companies and make them think twice about trying to scam people.

Yeah I agree. I was joking about what I said earlier, but I seriously want to know how is a company suing another company over this? Isn't this a consumer vs company issue?

So a company owned by Jared Wheat who has served jail time for illegally selling Rx drugs online is now fighting for justice.

Hahaha it's all marketing 100%. Hi-Tech seems like they really want to play up the "fighting for the people" angle, hence my earlier joke.

Unfair business practices. If you're claiming 40, but have 20, allows you to sell at a price that isn't realistic because you have half the cost into your goods. It's similar to the lawsuit kramer brought against gaspari. Kramer claimed gaspari had drugs in this OTC products, which created an unfair business environment because legal supplements can't complete against illegal ones.

doubt its marketing. considering the spotlight on hi-tech, it probably takes a mountain of money to be clean as a whistle. watching MP get away with fraud according to the SEC and raking in millions of dollars spiking supplements doesn't sit well with many companies, especially those spending millions to be fully compliant.

Ok looks like I was mistaken, bc this perspective makes a lot more sense. Hahaha I make a lot of jokes and throw things out there, but I'm always willing to acknowledge when I've put my foot in my mouth. Does Hi-Tech even sell protein products though? And did Kramer even sell supplements or did he just have that bogus site to act like he did for lawsuit purposes?

If this cleans up the supp industry, with other companies making sure the competition is playing fair, then I'm all for that.

How is this fraud according to the SEC? This has nothing to do with the SEC lol

i didn't say this was fraud, i said they were charged with fraud.

I just threw a MP combat jar away, the stuff is nasty and I am not sure if it has protein inside...

The question I have, is how many products has Hi-Tech manufactured for other companies in which they knowingly spiked protein content with aminos? I know of one large brand for sure.

This. Unfair business practices for a product (protein) that has a history of small margins. Advertising half the protein and filling with cheap fillers lets them profit at a price below what others who match label claims can competitively price at without losing money. Which not only did Hi-Tech sell protein during this time, but they manufactured a lot of protein from brands which could ultimately have been hurt from this and them in turn with a potential of less goods to manufacture.

If someone feels that way or believes that to be true, then they could bring up a legal matter against them. I've yet to sue anyone in this industry, not for a lack of reasons, it's just not worth it. Lawyers make out link bandits and everyone else just ends up pissed off and annoyed.

I've never met Jared, so I have no comments about the guy, but I have to give him credit, whatever he thinks he needs to do, he's willing to put the resources behind it. He's made a lot of strong moves that I totally understand. He has positioned himself in a unique way for long term stability within the the industry. Advantages of having your own manufacturing.

Thanks for posting this -- makes a lot of sense and while it's incredibly logical, it's not the first place my brain went to on its own, so I appreciate the "nudge" in the right direction of thinking.

so how much protein is in combat powder, and is it spiked with sugar?

I think the new combat powder you can actually look up batch tests from the lot # which is a positive consumer step. But it's unfortunately reactionary from previous issues.

I'm someone who cares who gets my money on the other end, if you've ever cheated your customers I don't deal with them again.

That protein spiking was brutal.
They owe me half the value of the tubs I tried

The jar I had was bought last year, it tasted nasty and gave me upset stomach...I will never buy anything mp again. Maybe they ran the first batch through lab tests then changed the formula, this type of practice was very common in the supplement industry...No explode, gaspari and many others did just that....
