JULY 18--Claiming that their young daughter discovered a used condom in a Las Vegas hotel bed and then put the rubber in her mouth, a Scottish couple is suing Caesar's Palace for negligence and emotional distress. According to a lawsuit filed July 13 in Clark County District Court, five-year-old Caitlin Kilcoyne found the condom during a July 2004 Sin City visit with her parents Gerald and Jacqueline. Caitlin "found a used condom in the made up bed in her room...and placed the condom in her mouth," notes the complaint, a copy of which you'll find below. The Kilcoynes contend that, following the incident, they incurred expenses for medical treatment, hospitalization, x-rays, drugs, and "evaluation and treatment of Caitlin's condition." The lawsuit does not indicate what, if any, lasting damage was caused to the child. The complaint, which seeks in excess of $10,000 in damages, claims that the family has suffered "shock, horror, fear, anxiety, and distress."

LMAO. Thats the funniest thing i've heard in a long time. Could you imagine the parents taking her to the doctor and explaining that? Good lord...
 
How did the used condom end up in the made up bed? sounds like negligence to me.

ive been to las vegas. the most heavenly part of hell on earth. if you want to break every rule ever laid down in holy scripture LV is the place to be. They have mexicans hand you porn on the city streets. Every single corner there is porn galore. they even shove porn in the fences. It is a city of porn.
 
The parents should be testing the child for STD's and get refunded for those expenses but to sue for $10K is ridiculous. I'll look out for used condoms not entering my mouth next time I'm in Vegas LOL
 
well actually have you ever been to a hospital without insurance if they were from out of the country and didn't have health insurance the bills could very well run into the upper thousands one time i was charged like 8500 for 2 xrays and cleaning and bandaging a cut nose and eyebrow. and i was only treated for like 1-2 hours max
 
Why should the hotel be responsible? **** happens. Not every accident means someone needs to get sued. Kids put stuff in their mouths all the time. Watch them.
 
And if the kid picked up her dad's razor, and cut her lips, I suppose they should file a law suit with Gillette?

What is the actual danger to the child of a used condom in the mouth? Is there any possibility of a disease being transmitted in this fashion?
 
Yes. Condoms arent foolproof, or so ive heard. Ive never used one. I mean thats just sick. If it was used, there could be diseases not only on the inside, but on the outside too. How about genital herpes of the mouth. Charming no?

That kid could get HIV, herpes – etc … from ingesting the semen inside the condom.

I would sue for much more than 10 grand.

i think that i would be alittle upset about this..... would i sue......no. i would definitely have them reimburse me for the med bills though. used condoms are a very dangerous thing! seriously. id be freakin pissed.
 
Why is a 5 year old sticking things in her mouth????? To me that is way too old for a child to be putting random objects into her mouth.
 
Considering what most Americans would sue for, the hotel would actually be getting off cheap. Given the situation, $10,000 doesn't sound ridiculous. You can't watch kids every second. If the child was exposed to something contagious, the risk is still there whether the parents saw it immediately, or 10 hours later, it doesn't matter.

From the hotel's point of view I understand them not wanting to immediately hand out a settlement. People try to run scams in casinos daily. They are use to people trying to pull every trick in the book (and invest millions in security and fraud detection etc.). However, if the parents can produce proof that they did do all of the testing etc, the hotel should cough up $10,000. In all honesty, most people would be suing for outrageous amounts of money. Testing your child repeatly (one test immediately is not assurance that the kid didn't pick up any diseases) over a few years and having to deal with that possibility would be "worth" a lot more to most people. I imagine the amount that goes to pain and suffering isn't really a large sum in this case, as they have real and justified expenses. Hell old bags get 90 million for spilling hot coffee on themselves.

On the other hand, if it was a scam, these people and everyone else that tries such things ought to have to pay at least what they tried to sue for in addition to jail time. There isn't enough done to curtail the professional sue'rs epidemic.
