Senate Confirms Alito for Supreme Court

Samuel Anthony Alito Jr., the son of an Italian immigrant and a longtime lawyer, prosecutor and judge, was confirmed as the 110th Supreme Court justice in one of the most partisan votes for a high court nominee in modern history.
 
I have mixed feelings about him.

On one hand he seems all about limiting the power of the Federal government. He has repeatedly ruled against using interstate commerce laws to justify various bans and whatnot (the entire premise of the Federal DEA is centered on this).

On the otherhand, he seems to think it is perfectly ok for the Federal government to spy on its own people without any warrants whatsoever. I'm rather confused at that one since on everything else he seems to be a very very strict Constitutional literalist. Yet his opinion on that seems to completely and totally ignore search and seizure laws set forth in the friggin Bill of Rights.

Kind of like Bork, in that free speech applies to everything except pornography for some reason. When you read these justices' decisions basically they all torture and mangle logic at some point to reach a conclusion that's ideologically satisfying to them even if it's not quite in line with the spirit or letter of the law they're ruling on. All in all he might provide a curb on some abuses of government power, but he'll let some slide through for various reasons. In the end he won't rock the boat of the state significantly one way or the other I think.

Good point. I guess I was thrown off by the fact that a number of his decisions contradicted each other as far as political party goes but still adhered strictly to a literal interpretation of The Constitution. So I expected the same there.

I suppose it means that his political bias on that issue does find its way through.
 
he is actually a very very solid justice... not many had anything against him.. it was a party line vote however... if they really thought this guy was going to rock the boat.. they would have thrown out all the stops to prevent it.... i mean.. how could they live with themselves knowing they did nothing to prevent his appointment....

i think kerry's flubberbuster really hurt the democratic party for the next nomination.. and the next should really confuse people... either a black conservative judge, woman, black woman, or asian... whom ever it is.. she/he will be more of a constructionist than Alito, or Roberts
 
I think Alito is a good choice. I just don't know WTF Bush was thinking nominating Harriet Miers before considering Alito.

Courting the women vote while still staying loyal to his gang. Whats funny about these convermations are that there is a history of Presidents nominating a guy/girl because he believes that this person is like him and they turn out to be completly different from what evrubody thought.
