Yes unless during a time of war then they fall under Department of the Navy

The president does have the option to make that happen at any time, and congress can make that happen during a time of war - but that hasn't happened since ww2, and the uscg has been involved in every major war since. I think nowadays the pros of DHS operation outweighs the cons when talking about an xfer.
