this isn't new zealand and the folks who founded the States, those who follow in their footsteps as Libertarians or conservatives have no desire to mimic Kiwi politics. For instance, there are over 21 million LLC's in the States, many of these are for small businesses and provide a veil of protection to the owner of the company. Bankruptcy is a sign of hard times but not an indicator of complete failure, it too is a protection veil to allow a company breathing room during a period of consolidation while it explores debt repayment scenarios.
The exact same thing happens at the personal level as well. In many cases it's no different than a homeowner getting a chance to refinance their mortgage to a lower payment when they fall on hard times (such as loss of job).
