"Thank you for taking the time to share your concerns. I believe you originally emailed our Marketing Director, Elizabeth, then our website, so it took a little bit for this to make its' way to me. I apologize for the delay. To answer your question regarding what you were told by a Trainer at the gym, yes, this is our Corporate policy to not allow photography or video inside of the gyms. Our official policy regarding this on our website and posted at the club is:
-No photographic equipment of any kind is allowed in the gym without prior permission/ approval from Bailey's Marketing Department. This includes the use of cell phones to take photographs.
As you stated, Florida and Federal statutes do allow private facilities to prohibit use of photographic equipment inside of their establishment. Obviously, in this day and age with so many people utilizing cell phones for photography and video, it is very hard to police this, however we do try to enforce this policy to the best of our ability. We have allowed several members to utilize a room that no one else is using to practice posing and record their posing for coaches, but this was/should be done with prior approval from management. On the gym floor it is almost impossible to take a photograph or video without capturing someone else in the background. This presents several problems, but the prevailing issue is that the person in the background did not give you permission to take their picture/video, and if this picture/video is posted online (which most are these days), it can result in a potential law suit for us. Our members expect a certain level of privacy within our facilities, and if were to allow anyone and everyone to take videos in the gym, we would not be upholding that expectation."
