can anyone comment on the current legality of the ephedra extract products? Im under the impression that the extract is still legal, and i cant find any info saying thats its not. But the health dept. is in my store right now seizing my lipodrene and stimerex line.

I thought they(Hi-Tech)were using a different portion of the Ma Huang plant to cheat the system. They even list the ephedra as coming from the leaves and not the stems on the bottle. The previous/current ban is on the stems, which yield the higher ephedrine alkaloid content.

I really don't see any clear cut info. stating that its legal to use the leaves vs. the stems. Here's some info.

REASON FOR
ALERT: Section 402(f)(1)(A) of the Act provides that a dietary
supplement or dietary ingredient is adulterated if it
presents a significant or unreasonable risk of illness or
injury under conditions of use recommended or suggested in
the labeling of the product, or if no conditions of use are
suggested in the labeling, under ordinary conditions of use.
We issued "Final Rule Declaring Dietary Supplements
Containing Ephedrine Alkaloids Adulterated Because They
Present an Unreasonable Risk" (69 FR 6787, Feb. 11, 2004)
based upon the well-known and scientifically established
pharmacology of ephedrine alkaloids, the peer-reviewed
scientific literature about the effects of ephedrine
alkaloids, published case reports of adverse events, and the
adverse events reported to us that have occurred in
individuals using products containing ephedrine alkaloids,
particularly dietary supplements. As set forth in the rule,
we have concluded that dietary supplements containing
ephedrine alkaloids pose a risk of serious adverse events,
including heart attack, stroke, and death, and that these
risks are unreasonable in light of any benefits that may
result from the use of these products under their labeled
conditions of use, or under ordinary conditions of use if
the labeling is silent. The final rule took effect on April
12, 2004.

GUIDANCE: Districts may detain without physical examination (DWPE) any
products labeled as dietary supplements that claim to
contain ephedrine alkaloids or one or more of the following
individual ephedrine alkaloids, if the labeling indicates
that the ephedrine alkaloid content derives from a botanical
source: ephedrine, pseudoephedrine, norephedrine,
methylephedrine, norpseudoephedrine, and
methylpseudoephedrine. Districts may DWPE dietary
ingredients intended for dietary supplement use that claim
to contain ephedrine alkaloids or one or more of the above
listed individual ephedrine alkaloids if the labeling
indicates that the ephedrine alkaloid content derives from a
botanical source. Districts may DWPE any products labeled
as dietary supplements if the labeling declares a plant
listed in Attachment A or an extract of such a plant.
Districts may DWPE dietary ingredients intended for dietary
supplement use if the labeling declares a plant listed in
Attachment A or an extract of such a plant.

A detained product or bulk ingredient may be released if a
firm is able to provide documentary evidence, such as
laboratory worksheets or certificates of analysis, that
provide assurance that it is free of ephedrine alkaloids.

Attachment A is a list of plants compiled by CFSAN that have
been shown to contain ephedrine alkaloids.

nope, it was two really fat women and im not sure if they even new the diff between extract and alkyloid, tho i did explain it to them, but they pulled all our product and then went to our other store in the next town over and seized their stuff too. She also said she was goin after lonestar, our distributor. The stores in texas bama

Sort of a side note, but I personally would never trust a company like Hi-Tech after this came out:

Anyway, sucks about your inventory getting seized, but I wonder if it's partly due to Hi-Tech's track record of spiking their products with actual drugs like Viagra. You may be better off just not selling their crap.

yeah, i dont really care they werent big selling products anyway, but as far as i know ethical or not their still legal for sale. I mean i dont push em or anything but i still carry em for those who want em. its like musletech i dont like it but if people dont wanna listen to me and buy it anyway, ill take their money for damned sure.

I hear you. I just wonder if there is something related to their former issues that led to the product seizure.

Hmm 2 fat women seizing fat burners...maybe it was the only place they could find ephedra and they needed to make sure they got all of it for future use? No I'm jk, that sucks that they just took it like that. If it turns out that they illegally seized your items, or if they are actually legal, I'm sure you could take them to court and have them reimburse you for your losses.

yeah i got their names and badge #s, and what they ended up telling me was that they had recieved no info from the fda concerning the legality of the product so they were seizing it. And they didnt actually sieze it. they put it in this taped up box with a notice on it that said it couldnt be sold or removed from the store under penalty of law. They only actually took two of the bottles for " Samples" they said. Ill prob get it back in 6 months when theyve gone through all their beuracratic bull**** and find out their just dumb and its legal.
