I don't know what exactly constitutes rape or if it is a case-by-case decision, but I would imagine "raping" a young MALE child (as long with some females) would frequently involve sodomy -- something that is almost incontestably malicious and brutal. You could even go as far as to say that it's a form of torture or deliberate/extenuating physical abuse -- which I certainly feel warrants the option to pursue the death penalty given the nature of such rapes.

Funny, though...much like Slavery, there is zero age guidelines in the bible and MANY instances of child rape - many times on orders from god. In addition, women are already treated almost subumanely where permission is not required at all. Rape means you have to marry or pay a fine.

it costs more money to keep someone in prison and death row than to kill them. for what like $.50 u can put a bullet in someones head but it costs like somwhere like $25,000 a year to keep someone in prison? people who rape children deserve to die...and i think the parents should have the option to do it themselves without any repurcussion...my 2 cents...cause i know when i have children and if that happens...that SOB is dead even before the cops get to them

I'm against the death penalty, but not in this case. I think child molestors and rapists are absolute scum. They should be put to death.

I remember seeing debates about this on MSNBC the other night. I do agree with the boundaries that some states have set, such as New York. If the girl is 16 years of age, then the man can be no more than 4 years older than her. Something like that. But there is a big difference between a girl being 16 and a girl being 12 or under.

I'm disappointed in the Supreme Court as well.

Messy? yes...but when people include relgion in their criteria to determine their opinion on the matter...or yet CLAIM to, yet speak in contradictions, then yeah it gets messy.

But remember we are speaking guidelines for state sponsored justice....not absolute justice. There is a difference.

I happen to agree with the decision. I would probably kill the individual in question if I were to have the chance but as far as justice is conerned I believ the punishment should be life in prison with no chance of parol.
