As part of *AAHF's mission to protect access and choice, we have filed three lawsuits in the U.S. District Court for the District of Columbia against the Food and Drug Administration (FDA) (along with dietary supplement formulators Durk Pearson and Sandy Shaw and the Coalition to End FDA and FTC Censorship).
AAHF is suing the FDA for violating the first amendment by reversing previously approved qualified health claims for selenium and antioxidants and denying additional claims supported by credible scientific evidence. The third lawsuit alleges that the FDA violated the Administrative Procedure Act’s (APA) prohibition on arbitrary and capricious action when it adopted a rule that subjects dietary supplement manufacturers to the same criminal penalties for minor paperwork violations as for selling contaminated products, without requiring a threat of harm.
