    FORT WALTON BEACH, Fla., Sep 7, 2006 (UPI via COMTEX) -- U.S. marshals have seized $55,000 worth of dietary supplements produced by Advantage Nutraceuticals LLC of Fort Walton Beach, Fla.

    The U.S. Food and Drug Administration said it ordered the EllagiMax capsules, Coral Max capsules, Coral Max without Iron capsule, and Advanced Arthritis Support capsules be seized after alleging the products violate a new drug and misbranding provisions of the Federal Food, Drug and Cosmetic Act.

    The FDA said the products are labeled as "dietary supplements," but the products' labeling, promotional literature, an audio cassette tape and two Web sites make claims typically associated with drug products. The capsules claim to benefit patients with cancer, arthritis, fibromyalgia, seizures and other conditions, the FDA said.

    The labeling caused the FDA to classify the products as unapproved new drugs, which must be approved by the administration before it can be marked to the public.

    The FDA has advised patients taking the capsules to consult with their doctors.

  4. I don't have a problem with the FDA shutting down shady character claiming their herbs can be used in the place of medicine to treat actual medical conditions.

    I posted this article however to highlight the legal thinking here. That if a "supplement" is held out for uses such as a drug, that it by default is a drug and is illegal to sell. This is very similar to the legal reasoning on the warning letter issued for superdrol.

  5. I agree...shady supp companies should be shut down. Companies like this are one of the reasons the FDA gives legit companies such a hard time.

  6. I worry about the claims about Novedex, NHA stack, Jungle Warfare etc as being testosterone boosters. The companies flat out assert that these products will incrrease your testosterone levels and this according to my readings of the DSHEA violates FDA policies. I would not be surprised if there is a crackdown on these supplements as well. A damn shame too because they seem to work pretty well.

  7. I find this interesting because Green tea extract is promoted for having cancer fighting agents.

    Of course the claims aren't as drastic as these products... "in 4 weeks there was no sign of my prostate cancer anymore thanks to ______"

    I wonder why...???

  8. Advantage Nutsack-ceuticals is the kind of business making it hard for the legit ones to make a living. People like that will be the downfall of the industry.

  10. There is a difference in claiming a benefit and flat out making claims of a cure or a fix. It's all semantics. How the company words things determines a lot. They know better.......

The way the article is worded makes it sound as if an herbal type product that has great benefits should first be forced to go through the mafia...er...I mean FDA...and then, they can possibly yank it out of peoples hands because the giant drug companies would much rather make it more expensive (and out of reach of some people) so more money can be made by them.
